Terms & Conditions for NivCraft

These Terms & Conditions (“Terms”) form an agreement between you and NivCraft (“NivCraft”, “we”, “us”, or “our”) concerning the NivCraft mobile application and related services. NivCraft is operated by the developer identified for NivCraft in its Google Play listing. Contact: support@nivcraft.in.

1. Acceptance

You must read and affirmatively accept these Terms before using NivCraft. Your acceptance is recorded with the Terms version and time. If you do not agree, do not use the service. You must accept again after deleting and recreating your account. If we make a material change, we may require acceptance of a newer version.

The Privacy Policy explains how NivCraft handles information and is incorporated into these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering this agreement. You may use NivCraft only where lawful. If you use it for an organization, you confirm that you have authority to bind that organization.

3. Paper trading and no financial advice

NivCraft is an educational and simulated paper-trading service. It does not route or execute real-money orders and does not hold customer funds or securities. NivCraft is not a broker, stock exchange, investment adviser, research analyst, portfolio manager, or fiduciary.

Quotes, signals, scans, option-chain information, calculations, backtest results, rankings, behavior insights, community content, and other outputs are provided for learning and informational purposes. They are not investment advice, a research report, an offer, or a recommendation to buy, sell, or hold anything. Simulated results do not represent actual execution and do not guarantee future results. Real trading can result in substantial or total loss. Obtain qualified independent advice and perform your own research before making a real-money decision.

4. Market data, regions, wallets, and simulated results

Market availability is based on the region you confirm in NivCraft and the markets and providers enabled for that region. You may be offered India Equity, US Equity, Coin Spot, Coin Futures, or other markets as they become available. A provider may be delayed, unavailable, or limited by its own terms, your connection, market hours, or your account access.

Paper wallets are simulated balances, not bank accounts, stored value, securities accounts, or real currency holdings. A trade uses the applicable simulated wallet and its settlement currency. NivCraft does not automatically move funds between your paper wallets. Where a displayed amount is converted, the conversion is an estimate using the configured currency-data provider and may differ from an executable exchange rate.

Live paper wallets, pending orders, positions, generated signal histories, backtest configurations and results, and market-data caches are local-first on your device and are not synchronized to the backend or restorable across devices. Your closed trade history, watchlists, strategies, and scan settings for Signals and Live F&O are saved locally first and synchronized to the backend for restoration when you reinstall NivCraft or sign in on a new device. Synchronization requires connectivity and a successful upload; changes that have not reached the backend cannot be restored from it. Generated scan results and signal histories remain device-only; the backend also uses closed-history records to prepare the Community ladder and may approve restricted lifecycle actions such as a wallet reset. Device loss, app-data clearing, or uninstalling will remove your local-only wallet balances, positions, pending orders, and market-data cache unless covered by an available device backup outside NivCraft’s control; your closed trade history and watchlists can still be recovered from the backend as described above.

Market data may come from connected brokers or other providers and may be delayed, incomplete, unavailable, adjusted, or incorrect. Simulated fills, charges, margin, liquidity, slippage, taxes, corporate actions, contract specifications, expiries, funding, and execution assumptions can differ materially from live markets. Coin Spot and Coin Futures are educational simulations only and are not cryptocurrency custody, exchange, derivative, or trading services. You must not rely on NivCraft as the sole source for a real transaction, compliance obligation, valuation, or emergency decision.

We may change simulation assumptions to improve realism. Historical results may change when calculation rules or corrected data are applied.

5. Accounts and security

You must provide accurate information, keep your device and connected accounts secure, and promptly report suspected unauthorized access. You are responsible for activity performed through your account except to the extent caused by our breach of applicable law.

One person may not create duplicate identities to obtain repeated referrals, trials, or entitlements. You must not share authentication or broker tokens, bypass access controls, impersonate another person, or use another person’s broker connection.

6. Broker connections

Connecting a broker authorizes NivCraft to use the resulting session for the market-data features you request. Broker services are independent, apply their own terms, and may revoke or expire access. You remain responsible for your broker account. NivCraft does not use the connection to place real orders.

For Upstox and FYERS, you connect through your own developer app registered with that broker. You supply that app’s API Key and API Secret (and, for Upstox, a separate Analytics Token if you use that connection method) to NivCraft, which stores them only on your device to perform the broker login itself; NivCraft’s backend never receives or stores these values. You are responsible for keeping your developer-app registration and its credentials valid and secure, and for any activity the broker attributes to that app.

7. Signals, background scanning, and notifications

Signals are rule-based technical observations, not advice. Enabling Signal Notifications authorizes the app to perform supported background work and show notifications until you disable Signal Notifications, the daily signal allowance is reached, or Android prevents the work. Delivery, timing, and completeness are not guaranteed. Background restrictions, connectivity, market hours, provider limits, subscription limits, or device settings can interrupt scans. Signal processing is performed on the device; broker market data is requested from the selected broker/provider by the app.

8. Charts, chart trading controls, and price alerts

Charts, indicators, drawings, chart trading controls, and price alerts are informational and technical tools, not advice. Chart Buy, Sell, Add, Reduce, Close, Modify, Cancel, entry, stop-loss, and target controls act only on NivCraft paper-trading records. They never submit, route, amend, or cancel a real-money broker or exchange order. A chart interaction is subject to the same simulated-order validation, local persistence, monitoring limits, and confirmation flow as the corresponding Positions or Orders action.

A price alert is evaluated by rule against live prices; delivery, timing, and completeness are not guaranteed, and connectivity loss, background restrictions, provider limits, or device settings can delay or prevent an alert from firing. Chart drawings, indicator templates, last-used timeframe, chart trading display state, and alert configuration are stored on your device only and are not backed up or restorable across devices or after an app reinstall. The in-app charting library is provided by a third party under its own attribution requirement shown in the chart.

9. Community content

You retain ownership of content you submit. You grant NivCraft a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, and distribute that content only as needed to operate and promote the NivCraft service. This licence ends when the content is deleted, except for lawful retention, backups, and content already shared by others.

Community has one feed containing Trade Ideas, Shared Trades, and general Posts. A Trade Idea or Shared Trade requires an entry, stop loss, target, and hypothesis. When a simulated trade is shared, values already present in its source snapshot are immutable. Only source values that were missing at sharing may later be completed or edited, while the hypothesis remains editable. You must not falsify, misrepresent, or manipulate simulated results or provenance.

Users may follow profiles, block other users, vote, comment, reply to a maximum displayed depth, and mention eligible participants. Notifications can be delayed, batched, unavailable, or disabled by device or service settings. The ranking is a recent monthly simulated-performance view prepared periodically from eligible closed-history records. Its size, availability, and calculation may change, and it is not a yearly record or proof of investment skill.

Community content is short-lived: it is automatically removed using the administrator-configured retention period, currently 35 days, and may also be removed earlier by its author where allowed, moderation, account deletion, or an administrator purge. Deleting a parent removes its child thread data. Do not rely on Community as permanent storage.

You must not post unlawful, deceptive, abusive, harassing, infringing, manipulative, promotional-spam, or personally sensitive content. Do not present Community content as regulated advice or guaranteed returns. We may moderate, restrict, or remove content and accounts, but we do not endorse, verify, or pre-screen every submission.

10. Subscriptions, Google Play billing, and renewals

Some features and higher limits require a paid entitlement. Current plan features, price, currency, duration, taxes, and renewal terms are shown before you buy.

Billing is handled by Google Play. When you buy a plan, Google Play (and Google Payments) charges your Google Play payment method and manages the subscription. NivCraft does not receive or store your card, UPI, or bank details. Google Play’s terms and Google’s Payments and Privacy policies apply to the transaction.

Paid access begins only after successful server verification of your Google Play purchase and can fail closed while entitlement confirmation is unavailable or expired. A cached entitlement is account-bound and time-limited and must not be altered or bypassed.

Unless a plan is expressly offered as one-time, subscriptions are auto-renewing: Google Play automatically renews the subscription and charges the renewal price at the start of each new period until you cancel. NivCraft keeps your entitlement in step with the state Google Play reports, including renewal, cancellation, grace period (a short window while Google retries a failed payment), account hold, pause, and expiry.

Managing and cancelling: you manage or cancel the subscription in the Google Play app, or at play.google.com/store/account/subscriptions, or via the “Manage subscription” link on the NivCraft Subscription page, which opens Google Play. If you cancel, you keep paid access until the end of the period you have already paid for, and the plan then does not renew. NivCraft does not issue Google Play refunds or change your subscription payment method. The account-deletion process requests renewal cancellation as described below.

Refunds are handled by Google Play under its refund policy and applicable law; contact Google Play for a refund request.

When you request account deletion, NivCraft first asks Google Play to stop future renewal and confirms the reported renewal state before completing backend account-data deletion. If Play is unavailable or cancellation is not confirmed, the account is locked and deletion remains pending while the backend retries; cancellation and deletion are not represented as complete. You can also manage or cancel directly in Google Play at play.google.com/store/account/subscriptions. Deleting or uninstalling the app alone does not cancel a subscription. Stopping renewal does not request a refund or restart the paid period; any existing payment commitment remains governed by Google Play. You may return to use valid remaining access under its original expiry.

Signal detection allowances, where configured for a tier, are daily limits on distinct on-device signal events. Reaching an allowance stops further scanning and disables Signal Notifications until the allowance resets or the entitlement changes.

11. Advertising

Where advertising is enabled for your tier, NivCraft shows ads supplied by Google AdMob. The Privacy Policy describes the data the ad network processes and your choices, including resetting your Advertising ID and, in the EEA, the UK, and Switzerland, a consent prompt for personalized ads. A paid ad-free tier removes ads; your current tier’s advertising behavior is shown on the Subscription page.

Some features may offer an optional rewarded ad: if you choose to watch it in full, NivCraft grants a small extra in-app allowance for the current period, such as one or more additional paper-wallet resets. A rewarded ad never grants money, additional simulated capital, or anything of cash value. The allowance is a simulated in-app benefit only, is not transferable, and may be limited, changed, or withdrawn. Availability depends on ad fill, your tier, and configured limits.

You must not click or interact with your own ads other than as a genuine user, generate invalid or automated ad traffic, encourage or incentivize others to click ads, use tools that block, spoof, or alter ad delivery or measurement, or otherwise interfere with the advertising or its integrity systems. Ads are provided by third parties; their appearance is not an endorsement by NivCraft, and NivCraft is not responsible for third-party advertised products, offers, or destinations.

NivCraft and its software, design, branding, documentation, calculations, and non-user content are owned by or licensed to us and protected by applicable law. Subject to these Terms, we grant you a limited, personal, revocable, non-transferable, non-exclusive licence to use the app for its intended purpose. No other rights are granted.

Third-party names, market data, and trademarks belong to their respective owners. Their appearance does not imply endorsement.

14. Availability and changes

Features may be enabled, disabled, limited by platform or plan, placed in maintenance, changed, or discontinued. We do not promise uninterrupted, error-free, or permanently available service. We may issue required updates for security, compatibility, or compliance.

15. Suspension and termination

You may stop using NivCraft or delete your account at any time. We may restrict or terminate access where reasonably necessary for a Terms violation, security risk, abuse, legal request, non-payment, provider restriction, or service discontinuation. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.

Account deletion runs the same centralized process whether you start it in the app or ask NivCraft support to run it on your verified request, and any lawful retention is described in the Privacy Policy and Account and Data Deletion page. Deletion removes the synchronized watchlists, strategies, closed trade history, and Signals and Live F&O settings held by NivCraft. Accepted in-app deletion also clears the local account data on that device, including scan histories and saved backtest results. Support-initiated deletion cannot remotely erase device-only data on other devices; follow the Account and Data Deletion page to clear those copies. Deletion clears your recorded Terms acceptance. If you return, the then-current Terms must be accepted again. Deletion requests renewal cancellation and remains pending until cancellation is confirmed.

NivCraft retains a restricted entitlement grant-and-revocation ledger and de-identified Google Play access-history events, including tier or plan, grant date, original expiry and revocation status. These records remain linked to a one-way account-identity hash so that, if you later sign up with the same verified identity, valid remaining premium access can be recognized without restarting its expiry or issuing duplicate welcome or referral rewards. Expired or revoked access is not renewed by returning. Retained history does not recreate deleted profile, Community, support, watchlist, wallet-balance, order, position or practice-trading content. Reusable Google Play purchase tokens are removed from operational records, access-history events and retained payment references after renewal cancellation is confirmed. Restricted retention is limited to these service-continuity, entitlement-integrity, fraud-prevention, dispute and legal/accounting purposes; contact support@nivcraft.in about a retained record.

Once the server accepts an in-app account-deletion request, local user data on that device is cleared even if backend billing or identity deletion remains pending. A device-local cleanup journal resumes interrupted cleanup when the app is next opened. This does not remotely erase unopened or offline devices.

16. Disclaimers

To the maximum extent permitted by law, NivCraft is provided “as is” and “as available” without warranties of accuracy, availability, fitness for a particular purpose, non-infringement, profitability, or suitability for live trading. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

17. Limitation of liability

To the maximum extent permitted by law, NivCraft and its operator, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss; loss of profits, opportunity, data, goodwill, or anticipated savings; trading or investment loss; or loss caused by market-data errors, simulated assumptions, community content, provider outages, advertising content, or unauthorized use outside our reasonable control.

Where liability cannot be excluded, our aggregate liability arising from NivCraft will be limited to the greater of the amount you paid directly for NivCraft during the 12 months before the event or INR 1,000, except where applicable law requires a different remedy. This section does not limit liability for fraud, wilful misconduct, or any liability that cannot legally be limited.

18. Indemnity

To the extent permitted by law, you will reimburse reasonable losses and costs arising from your unlawful use, your content, or your material breach of these Terms, except to the extent caused by NivCraft. We will give reasonable notice and allow your participation in the defence of a third-party claim.

19. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts having jurisdiction at NivCraft’s operator’s principal place of business in India will have jurisdiction, subject to mandatory consumer rights and any forum that applicable law requires. Before filing a claim, please contact support@nivcraft.in and allow 30 days for a good-faith attempt to resolve it.

20. General

If part of these Terms is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganization or service transfer subject to applicable law. These Terms, the Privacy Policy, and any Google Play purchase terms are the entire agreement about NivCraft.

21. Changes to these Terms

We may update these Terms for product, provider, security, legal, or operational changes. The current version and effective date appear above. Material changes may require fresh in-app acceptance. Continued use after any required acceptance means you agree to the updated Terms. The centrally hosted public version linked from the app is controlling; copies bundled with source code are non-controlling publication mirrors.
